		<Abstract>One of the most significant issues in the terminology of democracy and democratic governments is legitimacy (better known as &lt;em&gt;mashroo’iyyat&lt;/em&gt; in Islamic terminology). In a democratic system, first of all, one should answer these questions: where does the credibility of the government come from and what is the role and position of the people in the government? Hence, in explaining the nature of the Islamic Republic of Iran’s system, the issue of legitimacy  plays a vital role; yet, investigating and analyzing the theory on legitimacy of the Iranian ruling system is essential. The Islamic government, which is proven to have divine legitimacy and derives its legitimacy from the Sharia, needs social legitimacy as proof and in the realization stage, and its  manifestation lies in people&#039;s choice and public consent, and the legislator of constitution also accepts the two-element legitimacy and knows it as the real concept of the Islamic Republic and thus has extended it to all the institutions arising from the constitution. 			<OtherAbstract Language="FA">مشروعیت را باید یکی از مسائل مهم در قاموس مردم‌سالاری و حکومت‌های مردم‌سالار دانست، در نظام مردم‌سالار قبل از هر چیز باید به این سوالات پاسخ داد که اعتبار حکومت از کجاست و نقش و جایگاه مردم در حکومت چیست، از این رو در تبیین ماهیت نظام جمهوری اسلامی ایران نیز مسأله مشروعیت نقش اساسی دارد. این مقاله با روش توصیفی تحلیلی و با جمع آوری اطلاعات به روش کتابخانه ای و اسنادی در مقام پاسخ به سوالات مربوط به مشروعیت در جمهوری اسلامی ایران است. برایند مقاله این است که حکومت اسلامی که ثبوتاً دارای مشروعیت الهی است و حقانیت خود را از شریعت می‌گیرد، در مقام اثبات و در مرحله تحقق، نیازمند مشروعیت اجتماعی است که ظهور آن در انتخاب مردم و رضایت عمومی است و مقنن اساسی نیز مشروعیت دو رکنی را پذیرفته و ترجمان جمهوریت اسلامی می‌داند و آن را در همه نهادهای برآمده از قانون اساسی تسری داده است و ساختار مشروعیت الهی – مردمی نیز می‌تواند نظریه دموکراسی محدود و مقید به شریعت را قابل فهم و قابل دفاع نماید.</OtherAbstract>
